Joining the lottery

On receipt of your request to join this membership lottery. JWF Lottery will send you an introduction letter advising you of your unique game number (or numbers) and further information about how your support will benefit the charity. Your unique game number will be generated randomly by our lottery software during the process of setting you up as a new member. JWF Lottery may also reject an application, at their discretion, if they consider they have sufficient reason to do so. The applicant would have the right to appeal against such a decision. Lottery subscriptions

In return for your subscription payment your unique game number will be entered into the monthly draw, which is carried out every month. The cost of entry is £4.50 per chance, per draw, payable in advance.

James Whale Fund for Kidney Cancer cannot accept liability for the loss of or delays in or theft of any communication sent either by post, email or fax, or for any delays in the banking system.

Full Terms and Conditions

  1. These terms and conditions are the Lottery Rules. By entering the lottery, entrants agree to be bound by these rules.
  2. This lottery is being promoted by and on behalf of James Whale Fund Ltd. trading as James Whale Fund For Kidney Cancer (JWF) and this lottery will be known as the Kidney Cancer Lottery.
  3. For the purpose of the Gambling Act 2005, this lottery is defined as a ‘Small Society Lottery’.
  4. This lottery is licensed by South Cambridgeshire District Council.
  5. To enter the lottery, you must be a UK resident aged 16 (sixteen) or over.
  6. All members must be registered by Name and Address. Nom-de-plumes will not be accepted.
  7. One winning number will be drawn each month and the winner will receive a cash prize in proportion to the number of entries. 40% of the money collected weekly will be given back in the cash prize and the remaining 60% will go to the charity.
  8. All tickets shall be priced at £4.50 per chance.
  9. All lottery entry sales are final and no refunds shall be made at any time. All entrants acknowledge that their payment of 4.50 per ticket to enter the lottery does not guarantee that they will win any prize.
  10. All numbers are issued by JWF Lottery. The next available five digit game number will be issued with the confirmation of entry. Each game number is unique. Any member may subsequently request an alternative game number if they wish at any time and this will again be selected by JWF Lottery. To win a prize, the member’s number must match exactly the winning number drawn that month.
  11. The draw for the prizes will be made at monthly by JWF Lottery. The draw will be made on the last Friday of each month. This will be the date of the lottery (as defined in the 1976 Lotteries and Amusements Act) and details of the winners will be announced on a dedicated JWF Lottery webpage on the JWF website (www.jameswhalefund.org). You do not need to be present at the draw to win the lottery.
  12. The cash prize will be awarded by cheque in the name of the entrant only.
  13. The winners of the Lottery prizes will be notified by letter to the address shown on the entry form, unless amended subsequently. No responsibility can be accepted for any error, misprint or omission and the Official Winners list will be available for inspection on the JWF website.
  14. Full payment for each number must be received either in the form of cash or cleared funds before the number can be entered into the draw. Only numbers for which full payment has been received either in the form of cash or cleared funds are eligible to win the prize.
  15. All entrants are solely responsible for providing JWF Lottery with their accurate and up-to-date contact details and JWF Lottery will be in no way liable for any failure or inability to contact any entrant due to any errors, omissions or inaccuracies in the contact details that the entrant has provided. In the event that an entrant changes their contact detail, they will be solely responsible for advising JWF Lottery of the change.
  16. Lottery membership can be cancelled at any time by notifying JWF Lottery in writing or via e-mail.
  17. The Responsible Person reserves the right to refuse any person entry to the draw for any reason whatsoever.
  18. In the event of a complaint, please follow our complaints procedure, and in the first instance send your complaint in writing to the JWF Lottery registered office address.
  19. JWF Lottery is committed to protecting the member’s privacy. Data that is collected from the member is used lawfully in accordance with the Data Protection Act 1998 and is used solely for the purpose of processing lottery chances, subsequent entry into the lottery draw, and informing winners that they have won a prize.
  20. Any member has the right to access the information held about them. To obtain this information, please contact JWF Lottery in writing.
  21. JWF Lottery will not sell, rent or grant access of any personal data to any third party without express prior permission.
  22. In the event of any dispute regarding the rules, the decision of JWF shall be final and no correspondence or discussion shall be entered into.
  23. JWF Lottery reserves the right to amend these rules at any time. If JWF does this, it will publish the amended rules.
  24. JWF Lottery reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of these rules.
  25. The Responsible Person promoting the lottery is Mr John Chapman.
  26. This lottery is a form of gambling. Participants are encouraged to gamble sensibly.
  27. An instruction to be self excluded, as defined in the Gambling Act 2005, from the JWF Lottery may be submitted in writing, emailed or faxed through to the JWF Lottery Office. Members wishing to use this facility will not be able to re-join the Lottery for a minimum of 6 months from the date of exclusion.
  28. A copy of these rules may be obtained by sending a stamped addressed envelope to JWF Lottery at the address shown below.
  29. The Laws of England and Wales shall govern the interpretation and/or enforcement of these Terms and Conditions and JWF Lottery and all entrants hereby submit to the exclusive jurisdiction of the English courts.
